In Memoriam: 1947-2008

photo: Bayard W. Heath, Esq.We are deeply saddened to report that Info Tech lost one of its treasures when Wick Heath passed away on October 3, 2008. He fought his illness with the same courage and determination with which he approached all aspects of his life, but in the end it finally overtook him. Wick joined Info Tech in 1990, and served as our Senior Antitrust Consultant for 18 years. His combination of keen intelligence, boundless energy, and wonderful wit made working with him productive and fun at the same time. Although we can never replace Wick, we are dedicated to carry on our work with the same courage, determination and energy that Wick exhibited in every aspect of his life.

Bayard “Wick” Heath was a Senior Competition Consultant at Info Tech from 1990 through 2008. Mr. Heath’s specialties were forensic economic transactional analysis, investigation/litigation support, and extensive use and development of tailored automated analysis systems.

At Info Tech, Mr. Heath assisted with antitrust investigations and litigation in a variety of industries including carbon dioxide, ferro-silicon alloys, synthetic carpets, carbon fibers, highway construction, vitamins, medical waste, sulfuric acid, and building construction, as well as other public and private commodity purchases.

Prior to joining Info Tech, Mr. Heath was a prosecuting attorney for 14 years, the last eleven of which were devoted to investigation and litigation concerning public purchase bid rigging conspiracies. Mr. Heath had extensive experience in the use and development of computerized techniques related to the investigation and litigation of bidding conspiracies, including real-time computer applications in connection with deposition and debriefing sessions. Mr. Heath repeatedly used his skill base to train others in the use of tools to detect bid rigging and collusion.

In the course of his earlier duties, Mr. Heath conducted antitrust bid rigging investigations of highway construction and public commodity purchases including school milk and liquid chlorine, and price-fixing investigations involving retail gasoline, construction materials, service industries, and infant formula. His ability to review statistical data and identify patterns of marketplace activity was a skill acquired through decades of real-world analyses.

Mr. Heath worked as the Assistant Attorney General for the Florida Attorney General’s Office, Antitrust Section, in Tallahassee, Florida, from 1979 to 1990. He worked extensively with automated systems and the supervision of systems personnel. In this role, Mr. Heath regularly formulated investigative discovery devices, and reviewed huge compilations of documents. The selection, analysis and organization of documents in connection with large-scale antitrust investigations and related litigation was a regular feature of Mr. Heath’s duties in the Attorney General’s office, as were the formulation and execution of litigation strategy.

Mr. Heath’s experience and skills translated into aggressive client assistance in the course of discovery of technical information, including electronic information, and the analysis of operations information, cost information and transactions. This background enabled Mr. Heath to serve as a bridge between the technical and expert spheres of activity and the legal/litigation spheres of activity, particularly in the context of complex litigation such as antitrust class actions, and other intricate commercial litigation.

Prior to his work with the Florida Attorney General’s Office, he was the Assistant State Attorney, Dade County State Attorney’s (Janet Reno) Office in Miami, Florida, from 1976 to 1979, where he worked on felony trials, extraditions and civil enforcement.

Mr. Heath obtained his Bachelor of Arts in Political Science at Washington & Jefferson College, and his Juris Doctorate from Suffolk University. Mr. Heath lectured and developed materials related to the issues of computerized antitrust investigations.
